What is a Geographical Indication?

A GI identifies eligible goods from a territory, region or locality where a quality, reputation or other characteristic is essentially attributable to geographical origin, subject to applicable law.

Can an individual person register a GI?

GI registration is generally collective. Applicant eligibility depends on the legislation and whether the applicant appropriately represents the interests of the relevant producers.

Is a GI the same as a trademark?

No. A trademark generally identifies a commercial source, while a GI identifies goods with the required relationship to a geographical origin.

What is an authorized user?

An authorized user is an eligible producer of goods associated with a registered GI who obtains authorized-user registration under the applicable requirements.

Can any producer from the region use the GI?

Location alone may not be sufficient. The producer and goods must satisfy applicable requirements, specifications, production standards and other conditions.

Can someone outside the region use a registered GI?

Unauthorised or misleading use may constitute infringement or otherwise violate applicable GI law, depending on the circumstances.

Can a GI be sold like a normal trademark?

GI rights have a collective and geographical character and should not be treated as an ordinary privately owned trademark. Commercial arrangements require GI-specific analysis.

Can a GI help local producers commercially?

A well-managed GI can support differentiation, authenticity and market positioning, but registration alone does not guarantee success. Quality management, participation, promotion, distribution and enforcement remain important.
